According to Lucy Koh, a US judge, Samsung has infringed
Apple’s iPad’s patents by their tablets. Interestingly she added that Apple
Inc. might face a problem for establishing the validity of these patents. These
comments came on Thursday in a hearing where Apple requested to ban the sale of
some Samsung products in the US.
From the beginning of the production of Samsung smartphones
Apple has been in competition with the company. Earlier the same day an
Australian court temporarily banned Samsung’s latest tablet from sale. Also
Apple sued Samsung before in April saying that the Galaxy smartphones and
tablets were mere copies of the iPhone and the iPad.
Though the various network providers are against Apple in
this but Apple still has to prove the validity of its patents. The US judge
also said that she would deny Apple’s request based on its “utility” patents.
Although she did not mention anything about the “design” patents Apple still
would face a problem to approve its appeal from the US court.
